Terms of service

These terms govern use of Agenza, operated by Agenza LLC. By using the service you agree to them. If you are accepting on behalf of an agency, you confirm you are authorised to do so.
The service
Agenza is subscription business software for insurance agencies. It is licensed, not sold. For as long as a subscription is current, the agency and the people it authorises may use the service for the agency’s own business.
Accounts
There is no public sign-up. An agency owner creates each account and is responsible for who holds one and for removing people who leave. Keep your password to yourself, do not share a login, and tell us promptly if you believe an account has been compromised.
Your data stays yours
The agency owns the business records it enters. We use them only to provide and secure the service, and to do what the agency asks of us. On request during an active subscription, or within a reasonable period after it ends, we will provide an export or delete the data.
Acceptable use
- Do not use Agenza to break the law or to breach an obligation you owe someone else.
- Do not attempt to reach another agency’s data, probe the service for weaknesses without our written permission, or interfere with its operation.
- Do not resell, sublicense, or copy the service, and do not use it to build a competing product.
- Do not upload material you have no right to upload.
Fees
Subscriptions are billed in advance through our payment processor at the plan and interval selected. Fees are non-refundable except where the law requires otherwise. A subscription renews automatically until cancelled, and cancelling stops the next renewal rather than refunding the current period. We will give notice before a price change takes effect.
Availability
We work to keep Agenza running and will give notice of planned maintenance where we can, but the service is provided as is, without a guarantee of uninterrupted or error-free operation. Agenza does not give legal, tax, accounting, or insurance advice, and it does not replace an agency’s own recordkeeping obligations. Pay figures it calculates are a tool for the agency and remain the agency’s responsibility to verify.
Limits
To the fullest extent the law allows, neither party is liable for indirect, incidental, or consequential losses, and our total liability arising out of the service is limited to the fees paid for it in the twelve months before the claim.
Ending the agreement
An agency may cancel at any time. We may suspend or end access for non-payment or for a serious or repeated breach of these terms, and will give notice and a chance to put it right where it is reasonable to do so.
Governing law
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules.
Changes
We may update these terms. If a change is material we will tell subscribing agencies before it takes effect, and continuing to use the service afterwards means accepting it.
